Merkel Charged with "Endorsing a Crime"

An interesting and strange development in Germany.  Der Speigel:

A Hamburg judge has filed a criminal complaint against Chancellor Angela Merkel for "endorsing a crime" after she stated she was "glad" that Osama bin Laden was killed by US forces. Meanwhile a new poll reveals that a majority of Germans do not see the terrorist's death as a reason to celebrate.

Schadenfreude, the enjoyment of others' suffering, may be a famously German concept, but it is apparently not a feeling that many Germans aspire to. The political and public fallout following Chancellor Angela Merkel's statement on Monday that she was "glad" Osama bin Laden had been killed was among the most hotly debated topics in the German media this week.

Politicians, including those within her own center-right coalition, said that no death was cause for celebration, and reproved the remark as un-Christian and vengeful.

But Hamburg judge Heinz Uthmann went even further. He alleges that the chancellor's statement was nothing short of illegal, and filed a criminal complaint against Merkel midweek, the daily Hamburger Morgenpost reported Friday.

"I am a law-abiding citizen and as a judge, sworn to justice and law," the 54-year-old told the paper, adding that Merkel's words were "tacky and undignified."

In his two-page document, Uthmann, a judge for 21 years, cites section 140 of the German Criminal Code, which forbids the "rewarding and approving" of crimes. In this case, Merkel endorsed a "homicide," Uthmann claimed. The violation is punishable by up to three years' imprisonment or a fine.

"For the daughter of a Christian pastor, the comment is astonishing and at odds with the values of human dignity, charity and the rule of law," Uthmann told the newspaper.

A Sober German Reaction

While the judge's reaction may seem extreme, his sentiments are apparently shared by 64 percent of the German population. That was the proportion of Germans who said bin Laden's death was "no reason to rejoice" in a poll published by broadcaster ARD on Friday.

I must say this is very strange coming from the descendants of the Goths whose military tradition extends back thousands of years, but I suppose the Germans have lived with such enforced pacifism since the War that they can do no other. What would Bismark say? Or aren't we allowed to ask?

Bin Laden's death may or may not be a reason to celebrate (I personally think the significance of the event has been greatly exaggerated here in the US) but to be "glad" he has been killed is not only unobjectionable, it is arguably required as a matter of simple decency.  If Merkel's statement is truly as "controversial" in Germany as Speigel makes it out to be, then Germany is, to be plain, not a civilized country.

Also, note the following bizzare remark in the article, whose inclusion, I submit, could only have been deemed appropriate by an idiot: "Schadenfreude, the enjoyment of others' suffering, may be a famously German concept, but it is apparently not a feeling that many Germans aspire to." 

What to say?  This is horrible.  It is quite of a piece with that infamous poll where some outrageous percentage of Germans thought the IDF was worse than the Nazis.  Are there any civilized Germans left to condemn this?

 Dear Stan,

you are absolutly right. I can say this as a German. There is a whole campaign on its way against the killing of Osama and the USA.The anti Israel crowd grows stronger, our media is full of hate.

Not for the first time I am ashamed for my fellow ciiizens.I watch the news and read the german papers  with disgust and I am thankful for the internet where I can read such wonderful blogs like NER.

I think there *are* some Germans who are pleased, even if we are not hearing much about them.

I suspect that the good folks over at 'Politically Incorrect', and a certain Thilo Sarrazin too, will have been quietly raising their glasses in a toast - in either good German beer or good German wine - to the American Navy SEALs who summarily ended the wicked career of Jihad gang boss, capo dei capi, Osama Bin Laden.

Heinz Uthmann maintains that  "as a law-abiding citizen and as a  judge sworn to justice and law" he is obliged to report violations of the criminal code (here Para. 140).

Uthmann must be fully aware of the incitement to violence in e.g.  the  hate-filled speeches of Germany's most famous revert to islam , Pierre Vogel.  Uthmann's silence and inaction in re Vogel and other  muslim hate-stirrers means that he himself is "endorsing a crime" and liable to prosecution.

"Heidi" -  immeasurably braver than dupe Uthmann - who did not stay silent on hearing Vogel's mahoundian barking.

 While I did not rejoice at the news of Bin Laden's death, I certainly wasn't unhappy. The man was instrumental in the death of  thousands of my fellow citizens who were just going about their daily lives. 

Germany , the rest of Europe, and the U.S. need to wake up to the malignant tumor that is in their and our midst. Islamists are on the march. They couldn't conquer us by the sword so now they are doing it by immigrating to our shores, lying about their real purpose, and using our political correctness as their weapon. Until everyone understands this, especially German judges who have their heads buried in the sand, this kind of thing will continue. I say hoorah for Merkel for having the courage to speak up. They do still have freedom of speech in German, don't they? Or is the subject of Islam off limits?
